§ 263-6. Exceptions from wireless telecommunications facilities permit.

  • A. 
    Except as otherwise provided by this chapter, no person shall be permitted to site, place, build, construct, modify or prepare any site for the placement or use of, wireless telecommunications facilities as of the effective date of this chapter without having first obtained a wireless telecommunications facilities permit. Notwithstanding anything to the contrary in this section, no permit shall be required for those noncommercial exceptions noted in § 263-7.
    B. 
    All legally permitted wireless telecommunications facilities, constructed as permitted, existing on or before the effective date of this chapter shall be allowed to continue as they presently exist; provided, however, that any visible modification of an existing wireless telecommunications facility will require the complete facility and any new installation to comply with this chapter.
    C. 
    Any repair and maintenance of a wireless facility does not require an application for a permit.
